This three bedroom home, tucked into a quiet lot overlooking the wetlands of Prime Hook National Wildlife Preserve, is a nature lover's paradise.  The wrap-around porch (a portion of which is screened) is situated high enough to have a wonderful vantage of the wetlands.  Take a stroll down the pier to the dock on the water to take in some incredible views or to launch your kayak for a trip up to the Broadkill River.  

This home features an open floor plan with living, dining and kitchen on the main floor as well as two bedrooms and one full bathroom.  The second floor has the master bedroom with private bathroom as well as a small reading nook at the top of the steps. 

Pet friendly for one small dog (under 40 pounds) with a non-refundable pet fee and signed addendum.  Ask your agent for details. 

All guests must supply their own sheets, towels and beach towels or OPT in for our linen rental package.

The property must be occupied for the entire rental period by the Guest signing the Lodging Agreement (Responsible Guest), and all occupants of the Property shall be supervised by the Responsible Guest.  The Responsible Guest must be at least 25 years of age.  If the party is made up of unrelated individuals (a group rental where the Responsible Guest is NOT the legal guardian/parent of any other guests), ALL guests occupying the property must be at least 25 years of age.


We accept Mastercard, Visa, American Express and Discover Credit Cards and eChecks for your initial deposit.  We also accept personal checks for final payments.  Final payments are due 30 days prior to your check-in date.  NOTE:  Any payments within 30 days of arrival require to be in certified funds or by credit card.  You will be provided a link to a Guest Portal where you can securely make your payments online.

This charming property offers a cozy, home-like atmosphere that resonates deeply with guests, making it a favorite choice for many. Surrounded by nature, it provides a unique experience, inviting guests to enjoy both comfort and the beauty of the outdoors.

I wasn't sure what to exspect this place to be. We have stayed in a few different houses over the years and this one from the picture don't due this house justice. It is super cute, feels very comfortable, like home. The furniture could use some updating, but it worked.I'm not sure if it had been cleaned either, the fridge and freezer had food it it and there was a water bottle left on the counter and dishes in the dishwasher. But everything else seemed clean. My only huge complaint is, because this house is surrounded my trees and other brush. Walking to your car or walking to the beach was a task. You were attacked by flies! We barely made it from the shed to the steps without having 50 to 60 flies around each of us, and biting! Then mosquitoes, almost just as bad. It yard needs a good cleaning and bug spraying. Definitely want to watch for snakes. Getting to the beach was tricky, not only were you bit by all thw flies in the driveway once you found the beach access it was interesting. We had a fox run out between the brush along the path. I say all of this juat to make others aware, but in all truthfulness this is probably one of my favorite house we have stayed in because it really just felt like home. 

For valuable consideration (the receipt of which is hereby acknowledged) and the mutual covenants contained herein, the record owner(s) (Owner) of the subject property (Property), through their agent Gallo Realty, Inc. (Agent), does hereby give the right to use and occupy the Property to Guest (Guest) under the following terms and conditions:

These Residential Lodging Agreement Terms, together with the Residential Lodging Agreement (hereinafter collectively referred to as the “Agreement”) are made by and between Owner of the subject Property , through their agent PenFed Realty LLC (“Agent”), and Guest.  All capitalized terms not defined herein, shall have the meanings ascribed to such terms in the Residential Lodging Agreement.  For good and valuable consideration, the sufficiency of which is acknowledged, the parties agree as follows:

1) OCCUPANCY GUIDELINES  The Property must be occupied by the Guest signing the Agreement, and all occupants of the Property shall be supervised by the Guest for the entire rental period. The Guest signing the Agreement must be at least 25 years of age and must occupy the Property for the entire rental period.  If the party is made up of unrelated individuals (a group rental), all guests occupying the property must be 25 years of age. We will hold Guest responsible for the conduct and behavior of other guests staying at the Property and other visitors/occupants of the Property who are not staying overnight.  Should the Owner or any representative of Agent ascertain that Guest does not meet these requirements, this Agreement is subject to immediate termination and Guest shall be evicted with no refund.  The occupancy (number of people sleeping in the Property) shall not exceed the number of persons identified as the Max. Occupancy in the Residential Lodging Agreement.”  Gatherings and parties are strictly prohibited, unless approved by Owner in advance.  A gathering/party is defined as any gathering that exceeds four (4) people over the stated Max. Occupancy limit of the Property.  This Agreement may not be assigned by Guest, and the Property may not be sublet for any reason.  Agent, exercising reasonable discretion, reserves the right to refuse occupancy, cancel any existing reservation, and/or terminate occupancy if the occupancy, deemed to be detrimental to the Property and/or the Owner, in Agent’s sole discretion.

2) PAYMENT TERMS:  Guest agrees to pay the Total Booking Charges.  The Initial Deposit is due and payable by the due date noted in the Residential Lodging Agreement.  The Initial Deposit is non-refundable, except as provided in Section 3 below, and will be applied toward the Total Booking Charges.  Payment in full of the Total Booking Charges, less the Initial Deposit, will be due by the date specified in the Residential Lodging Agreement. Guest may not take possession of the Property unless the Total Booking Charges have been paid in full.  If Guest fails to make any payment when due, then: a) Guest forfeits any right of possession; b) this Agreement shall be automatically terminated; c) Guest forfeits any deposit or rent payment made up to the time of default; d) Guest shall be liable for any outstanding payment still due under the Agreement; and e) Owner may re-rent the Property.

3) CANCELLATION POLICY: Guest acknowledges this is a legally binding Agreement. Guest is responsible for the payment of all amounts due as outlined in this Agreement.

a. Guest may request cancellation of the Agreement by executing a Cancellation and Re-Rent Form; provided however, Guest shall still be responsible for the Total Booking Charges, subject only to Owner’s duty to mitigate damages as provided in the Cancellation and Re-Rent Form.  Guest’s failure to provide written notice of cancellation and/or authorization for Owner/Agent to re-rent the Property will automatically result in Guest being held responsible for the Total Booking Charges.  If the Property is re-rented, any amounts paid by Guest pursuant to this Agreement which exceed the sum of the following will be returned:
          a)  Reservation Fee;
          b)  Travel Insurance Fee, if purchased
          c)  Cancellation Fee equal to 15% of the Total Rent; and
          d)  Any difference between the Total Rent and amount the Property is re-rented for during the rental period. 

b. INSURANCE:  Guest acknowledges that Vacation Rental Insurance is available as outlined in the enclosed brochure. Vacation Rental Insurance may provide coverage for prepaid, non-refundable expenses due to certain unforeseeable circumstances that may jeopardize your vacation investment.  Guest shall direct any inquiries regarding coverage directly to the insurance carrier.  Guest is not obligated to use Generali Insurance and is free to procure a policy from the carrier of their choice. Guest is responsible for complying with all applicable laws related to travel insurance based on Guest’s state of residency. Guest acknowledges that insurance for Guest’s personal belongings is Guest’s sole responsibility, as Owner’s policy does not insure Guest’s belongings.  Residents of New York or Hawaii are not eligible to purchase Travel Insurance thorugh PenFed Realty, but can purchase it on their own.

c. NO REFUNDS:  No refunds will be given for a) inclement weather (including hurricanes or storms or the evacuation of the Property caused thereby); b) beach replenishment; c) noise or disturbances caused by surrounding properties, their inhabitants, or construction; d) governmental restrictions or e) any other reason beyond the control of Owner or Agent.   Guest also acknowledges that the parties to this Agreement are the Guest and the Owner, and Agent has no authority to issue any refunds without the express direction from the Owner.

4) LODGING TERMS:  Linens/Towels are NOT included unless specifically specified in the Lodging Agreement.  They are available for rent.
It is agreed by all parties to this Agreement that:

a. NO SMOKING POLICY:  Guests are prohibited from smoking (all substances) in the Property.  Any residual signs of smoking indoors or smoking debris outdoors will incur additional charges (a minimum of $250 will be assessed if there is any evidence of smoking inside the rental property) and Guest’s credit card on file will be charged.  Guests may smoke legally acceptable substances outdoors if the Owner/community allows it, however doors/windows must remain closed, so smoke does not go inside. Guest is responsible for discarding all smoking debris appropriately.  These rules shall not be construed to imply any guarantee that the Property has been smoke free in the past, and Guest shall not be entitled to any refund related to prior smoking at the Property. 

b. Guest will not be provided access to the Property prior to the arrival time noted in the Residential Lodging Agreement, and not until the Property has been cleaned.  Agent, Owner, or their representatives and employees may enter the Property at any time for the purpose of inspecting, maintaining, or repairing. If the Property is also listed for sale, Guest will allow access for showings with a minimum two-hour notice.

c. Guest acknowledges that use of the Property by Guest and Guest’s visitors is entirely at their own risk.  Guest acknowledges that he has had the opportunity to personally inspect the Property prior to execution of this Agreement and accepts it in its “as-is” condition. Neither Owner nor Agent shall be responsible for any accidents, injuries, or illness that occur to Guest or any of Guest’s visitors while in or on the Property.  Neither Owner nor Agent is responsible for loss of personal belongings or valuables belonging to Guest or any of Guest’s visitors.  Guest agrees to assume the risk of any harm arising from use of the Property.  UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY SHALL OWNER OR AGENT BE LIABLE TO GUEST OR ANY OTHER PERSON FOR ANY DAMAGES OF ANY NATURE WHATSOEVER, INCLUDING ARISING OUT OF OR RELATING TO THIS AGREEMENT OR GUEST’S RENTAL OR USE OF THE PROPERTY, EVEN IF OWNER OR AGENT SHALL HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

d. Guest agrees to defend, Indemnify, and hold harmless Owner and Agent from and against any and all damages, loss, liability or expense, including attorneys’ fees and legal costs, suffered directly or by reason of any claim, suit, or judgement, brought by or in favor of any person or persons, including minors, for any damage, loss, or expense due to, but not limited to, bodily injury or death and/or loss of or damage to property sustained by such person or persons which arises out of, is occasioned by, or is in any way attributable to Guest's use or occupancy of the Property or the acts or omissions of Guest or Guest's invitees, including friends and relatives of Guest, except to the extent caused by the sole negligence of Owner, in which case Agent shall still be held harmless as stated above. Further, Guest agrees that Agent shall not be responsible or subject to a claim of negligence for any act performed in its capacity as agent for Owner, including acts performed in an incomplete, unsatisfactory or negligent manner and that any legal action for damages to property or injuries suffered by Guest related to any condition, maintenance or cleaning of the Property shall not create a right of action against Agent when it is acting on behalf of the Owner.

e. Owner or Agent may terminate this Agreement and remove Guest and all those on the Property at any time if, in the sole discretion of Owner and/or Agent, Guest or anyone else on the Property becomes objectionable, violates any term of this Agreement, violates any of the Property or Community rules and regulations, or has created a disturbance of the peace that has been reported to Owner, Agent or the police.  In such event, Guest agrees to immediately vacate the Property, at Agent’s request, without refund or recourse against Owner or Agent.

f. Where Owner provides a grill, television, telephone, cable/satellite, DVD, streaming service, internet service, microwave, icemaker, pool/hot tub, or other non-essential items, it is as a courtesy only. Repair, replacement, or rebate during the term of this Agreement is not guaranteed.  Where Owner provides a grill, if Guest fills any propane tank for a grill, they will be reimbursed with a valid receipt.

g. If a Community or HOA institutes an amenity fee or increases an existing amenity fee for Guest use after this Agreement has already been executed, Guest will be required to pay the new fee or the increased fee, whichever applies.  If a Community or HOA institutes new rules after this Agreement has already been executed, this Agreement will be subject to those rules and Guest will sign a new addendum if required.

h. The operation, maintenance, heating, opening, closing, and lifeguard coverage for any Property/complex with a swimming pool/spa is not guaranteed by Owner or Agent.  This applies equally  to any other amenity (including but not limited to fitness center or equipment, etc.).  No refund or rebate will be given for the closing of/inability to use a swimming pool/spa, fitness center, or other recreational facility/amenity, including beaches.

i. Utilities are included in the rental price unless specified elsewhere in this Agreement.  Many rental properties do not have a “land-line” telephone. If the rental period is for thirty (30) days or longer, Guest is responsible for all utilities, including but not limited to electricity, telephone service, water/sewer, cable, gas, and oil unless otherwise outlined in an attached Schedule A made a part of this Agreement.

j. No animals of any kind are allowed on the Property unless it is designated as a “Pet Property,” in which case a non-refundable pet fee is required per the Pet Fee Addendum. If this term is violated, it shall be grounds for immediate eviction and loss of any security deposit and all rent paid as liquidated damages for breach of contract. In addition, Guest will also be responsible for any damages caused by any animals on the Property, including but not limited to extermination, carpet and/or upholstery cleaning, and waste removal.

k. Should a multiple booking occur, or other similar circumstance, Owner/Agent reserves the right to cancel this Agreement at any time prior to Guest taking occupancy of the Property. In such event, Guest will be refunded all deposit money paid but Guest shall have no other recourse against Owner or Agent.

l. Guest maintains a permanent residence elsewhere and acknowledges that this is a transient lodging; therefore, this Agreement is not governed by the Delaware Landlord-Tenant Code.

m. This Agreement is not legally binding or effective until it is signed by Owner or by Agent, acting in its capacity as agent for Owner.

n. Guest will not be moved or refunded any portion of the rental amount after taking possession because of any claim by Guest that the Property is not clean or properly stocked with furnishings, appliances, or utensils, or because of the existence of and/or an allergic reaction to pets, dust, mold, mildew, extermination chemicals, cleaning solutions, smoke, or any type of insects or parasites.

o. Furnishings (including but not limited to bed sizes, types, and locations) are subject to change without notice.

p. Guests are NOT ALLOWED to use any outlets on the property (interior or exterior) for car charging purposes.  Guests must go to an established car-charging facility.

q. Guest acknowledges that this Agreement is for a property privately owned and maintained by the Owner.  While all electrical and mechanical equipment within the Property are in good working order, Owner cannot guarantee against mechanical failure of electrical service, stopped plumbing, water supply, heating, air conditioning, audio visual equipment, internet access, cable service, or appliances. Guest agrees to report any inoperative equipment or other maintenance problem to Agent immediately.  Should a repair be necessary, Owner/Agent will make its best effort to have the item repaired in a timely manner, but a specific timeframe cannot be guaranteed.  Guest will allow access to the Property for purposes of repair and inspection.  No rebate or refund shall be warranted due to a failure of such items, unless specifically agreed to by Owner.

5) DAMAGES: It is agreed by all parties to this Agreement that:

a. Guest will be required to sign an attached Damage Addendum, which outlines Guest’s options for damage protection through either a Vacation Rental Damage Insurance policy or a traditional Security Deposit.  Furniture, bedding, kitchen equipment, utensils, and any other personal property supplied with the Property are the property of Owner and must not be removed from the Property. Loss of any items within the Property or damage to the Property or furnishings in excess of normal wear and tear will be charged to Guest. If an item should break, Guest must notify Agent immediately.  .

b. Upon Guest departure, if excessive trash removal or additional cleaning incurs an additional cost, (including but not limited to general cleaning, linen laundering, carpet cleaning, grill cleaning, etc.), Guest will pay this excess amount above the normal cleaning fee for that property.  Upon Guest departure, if Guest fails to return any permits/passes (including but not limited to permits/passes for parking, amenities, etc.), Guest shall be responsible for a replacement charge. Guest’s credit card on file will be charged, or a supplemental check from Guest (without a credit card on file) will be required.

c. If during the term of this Agreement the Property is damaged by fire or other casualty, without fault or negligence of Guest, and is unfit for occupancy, this Agreement shall terminate, and any security deposit and the prorated balance of the rent shall be returned to Guest. If the Property is damaged prior to occupancy and cannot be made ready by the beginning date of this Agreement, this Agreement shall terminate, and Guest’s sole remedy shall be the return of any deposits, less the non-refundable Reservation Fee.  In either event, alternate lodging will be the sole responsibility of Guest.  

d. If a security deposit is selected or required, it is to secure the faithful performance of Guest’s promises and duties contained herein. Any security deposit, less any costs for repairs or damages or additional housekeeping charges, will be refunded by mail within thirty (30) days of Check-out.

6) AGENCY TERMS: Guest acknowledges that Berkshire Hathaway HomeServices PenFed Realty is a trade name of PenFed Realty LLC and Agent is acting only as the agent for Owner and not as a property manager or agent for an undisclosed principal.

a. It is agreed that Agent has no liability to either the Guest or Owner for the condition, maintenance, or safety of the Property or for the performance or non- performance of this Agreement.

b. Guest shall immediately give Agent notice of the need for any maintenance, repairs, or deficiencies related to the Property that Guest becomes aware of.  Owner shall have a reasonable period of time to correct any such issues, but in no event less than 48 hours after notification.  Guest acknowledges that repairs, refunds, rebates, etc. are at the sole discretion of Owner, and Agent has no authority to authorize such.  In addition, Guest acknowledges that any alternate lodging will be the sole responsibility of the Guest.

7) MISCELLANEOUS:  This Agreement shall be governed by, and construed in accordance with, the laws of the State of Delaware.  This Agreement shall inure to the benefit of and be binding upon each of the Parties and each of their respective successors and assigns.  This Agreement constitutes the sole and entire agreement between the Parties with respect to the subject matter contained herein, and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter.  No waiver of any term or right in this Agreement shall be effective unless in writing, signed by an authorized representative of the waiving Party. The failure of either Party to enforce any provision of this Agreement shall not be construed as a waiver or modification of such provision, or impairment of its right to enforce such provision or any other provision of this Agreement thereafter.  The rights and remedies of the Parties herein provided shall be cumulative and not exclusive of any rights or remedies provided by law or equity.  If either Party incurs any legal fees associated with the enforcement of this Agreement or any rights under this Agreement, the prevailing Party shall be entitled to recover its reasonable attorneys’ fees and any filing fees or expenses from the other Party.  If Owner incurs any costs, expenses, or fees, including reasonable attorney’s fees and professional collection services fees, in connection with the collection or payment of any amounts due it under this Agreement, Guest agrees to reimburse Owner for all such costs, expenses and fees.  The headings in this Agreement are for reference only and do not affect the interpretation of this Agreement.  As used herein, personal pronouns shall be construed as though of the gender and number required by the context, and the singular shall include the plural and the plural the singular as may be required by the context.  This Agreement may be executed in counterparts, each of which is deemed an original, but all of which constitute one and the same agreement.  Delivery of an executed counterpart of this Agreement electronically or by facisimile shall be effective as delivery of an original executed counterpart of this Agreement.
