Guest Vacation Stay Agreement
Premises: The subject property is located at «Property_Address». Oceans Luxury Realty Full Service LLC

2. Rent: Guests agree to pay Oceans Luxury Realty Full Service LLC advance rent, taxes, a mandatory
exit cleaning fee, and property protection plan costs for timely performance in compliance with all
terms of this agreement. If paying from out of country we must have a money order or cashier check
in USD funds.
Payment made shall be paid in the following installments: $500 advance rent is due at the execution of
this lease. The remaining balance is due 60 days before arrival. There is a $35.00 charge for returned
checks.

3. If reservation is within 60 days, payment in full must be submitted with executed Agreement.

Failure to meet these requirements will result in the cancellation of this booking.

4. Property Protection Fee: As a part of your stay, you must pay a Property Protection Fee designed to
cover unintentional damages to the rental property interior that occur during your stay upon inspection of the
premises after departure. The Property Protection Fee will pay a maximum benefit of $3000. If any damages
exceed $3000 the tenant will be held accountable. The Property Protection Fee must be paid at the time of
contract and is NONREFUNDABLE.

5. Keys/Security Gate Openers/Garage Door Opener. Upon check-in Guests will receive necessary keys and
garage door openers if applicable. Should Guests lock themselves out of the property, a $95 fee will be charged
to have a representative of the owner come and open the premises. Fees of $25-$200 per key and $100 per
garage-door/security gate opener will be charged for keys/openers lost or not returned to Owner. All charges
incurred shall be charged to the credit card on file.


6. Use of Premises: Guests agree to use the premises only as a single-family residence and agree not to
violate any ordinance, statute or administrative rule, applicable to the premises. Guests shall be responsible for
acts or failures to act by Guests or family members. Only the number of persons named in this contract may
use the property/premises (including day guests) unless otherwise approved by Oceans Luxury Realty Full
Service LLC in writing. We reserve the right to terminate the lease without prior notice and without refund or
compensation if the number of people is more than stated amount, or if there are unauthorized people on the
property at any time. In addition, there may be additional fees and charges for unauthorized guests. House
parties such as weddings and receptions are not permitted in the home or on the premises. Guests acknowledge
that only the people named in this contract are permitted in or on the premises at any time. Violation of this
agreement will result in forfeiture of all monies paid in full together with any additional costs involved and
immediate eviction of all persons in or on the premises. Any material breach of any aspect of this contract will
result in the immediate eviction of all persons with no compensation.
7. Condition and Maintenance of Premises. Guests agree to maintain the premises in its present condition
subject to any reasonable wear and tear. Kitchen trash shall be placed in exterior trash container prior to checkout. Guests shall not make any alteration or addition to the premises without prior written permission from
Oceans Luxury Realty Full Service LLC. In reference to our Condominiums, ANY guests who are caught damaging
any common areas or any area outside of the condominium building they are occupying will be entirely
responsible for ANY repairs that need to be made due to the damage they have caused. This includes anyone who
is on the lease agreement along with their day guests however the responsibility ultimately falls upon the
contracted tenant. The Property Protection Fee, as described in section 4, does not cover any damages outside of
the unit.

8. Pets: Not all properties are pet friendly. Check with your booking agent to ensure this property will
allow pets. ONLY the pets listed on the addendum may be at the premises. We reserve the right to terminate
the lease without prior notice and without refund or compensation if the number of pets is more than stated
amount, or if there are unauthorized pets on the property at any time. There will also be a charge of $250 per
pet which is NON-REFUNDABLE. Current vet certificates must be provided as well as proof of a flea/tick
preventative program.

9. Indemnification: Guests agree to indemnify and hold harmless the Owner and Agent(s) which may result
in any liability, theft, damage cost or expense whatsoever arising from or related to any claim and or litigation
which may arise out of or in connection with the use of occupancy of the rental property including but not
limited to the personal injury or damage or theft which is make, incurred or sustained by guests. The terms
‘Agents(s)’ and ‘Owner’ as used in this agreement shall include their heirs, successors in interest, assigns,
employees, agents and representatives where the context permits or requires. The term ‘Guest(s)’ as used in
this agreement shall include heir, successors, assigns, guests, invitees, representatives and other persons using
the rental property during guest’s occupancy without regard to whether persons have authority under this
Agreement to in or on the premises where the context permits or requires.
10. Surrender or Abandonment: Guests agree to surrender the premises upon expiration of this agreement.
In the event Tenants hold over (either in person or in failure to remove all personal property) after the end of
terms hereof, Tenants shall be responsible for payment double the applicable rent, computed on a daily basis
for each day of holding over. Tenants shall be responsible for any monies due in excess of the property
protection fee. In the event the contracted guest vacates the premises, any remaining occupants must also
vacate the premises immediately. As per above, the payment of double applicable rent will be charged to the
contracted guest for any remaining occupants.
11. Management: In the event that the owner should sell or withdraw the use of property for the rental
through Oceans Luxury Realty Full Service LLC, every effort will be made to rebook Tenants into another property
as deemed comparable per Oceans Luxury Realty Full Service LLC. If no other property is available all monies paid
will be refunded.

12. Cancellation. If cancellation is 60 days prior to check in date, all monies collected will be refunded
excluding the booking fee. If cancellation is less than 60 days prior to check in date, refund will only be given if
same property is re-booked for same time period at a rate equal to or greater than the amount of this
reservation, whether we rebook the property or not the booking fee is non-refundable. If you booked through
AirBNB, Oceans Luxury Realty Full Service will honor all cancellation policies in existence with AirBNB. ________

13. Double Bookings. Double bookings are rare. In the event that the guest’s reservation for the rental
property overlaps or matches the reservation of another guest, the agent reserves the right to relocate guests to
a different rental property within the agent’s rental program or that of another company. Guests will have the
option to (1) accept the replacement property or (2) reject the replacement property and receive a refund for the
original rental property. Guest agrees that the guest’s choice between alternatives will be tenant’s sole remedy
against any and all damages, liability, or inconvenience arising out of the double booking.
14. Age Limitations. Owner will not rent to anyone under the age of 25 unless accompanied by a parent or
legal guardian.

15. Access. Owner/ Manager/Agent/ Representative shall have the right to access the property during
tenants stay for the purpose of showing to prospective Buyers or Tenants, maintenance, inspection or other
typical reasons with notice to anyone occupying the property per this agreement.

ADDENDUM TO CONTRACT
In order to best facilitate your check in, please note the following guidelines:
1. Check in time is 4PM – Check out time is 10AM EST for all properties.
No exceptions for early check in’s or late check outs, unless approved by management.

2. Maximum of 2 vehicles total are allowed in the front parking area and driveway. Do not at any time
park in the street or on any surrounding property. Owner is not responsible for any damages to
vehicles. Boats, RV’s or Trailers of any type are not permitted on the property. NO EXCEPTIONS.
3. Absolutely NO SMOKING in the property is permitted. SMOKING FEE IS $500
4. In the event that any valid complaint is filed with our office, guests will be removed from the
Property immediately and no refunds of any sort will be given.
5. Guest must adhere to all local noise ordinances. Please keep this in mind with radios etc.
6. Some properties have internet. Inquire with your booking agent to find out if your property has internet
access.
7. During your stay please call our office at 386-455-0830 with any issues/concerns you may have. If any
maintenance issues occur during your stay they will be take care of accordingly. Be aware that if the
issue is taken care of within 48 hours of it being reported there will not be any refunds given.
8. IF your stay is between May 1st
 and October 31st, please note that this is a hatching time for the baby sea
turtles. It is Volusia County law that all balcony and porch lights MUST be switched off and drapes or
blinds just be closed for the safety of the newly hatched sea turtles. The beaches are patrolled to ensure
that this law is adhered to and fines are heavy for the condo-compliance ($1000/day). Guests are
responsible for any fines incurred. Please be mindful of this.
