VACATION RENTAL LEASE AGREEMENT

This rental agreement is entered into by and between ____________ (the “Tenant”) and Gore Creek Rentals, LLC, as authorized agent for the owner of the property (the “Owner”), as of this _____ day of                       __________, 20___. This occupancy will be in the form of a Vacation Rental only and not constitute a permanent or primary residence or other tenancy.

TERM OF LEASE:  The lease begins at 4 p.m. MT on__________(the “Check-in Date”) and ends at 10 a.m. MT on _____________ (the “Check-out Date”).

RENTAL RATES: An advance payment equal to at least 50% of the rental rate is required to confirm reservations. The advance payment will be applied toward the rental price. Credit Card payments are accepted from American Express, Visa, Mastercard, and Discover. The advance payment is not a damage deposit. The balance of the rent is due 30 days prior to your Check-In date, except for reservations between December 18 and January 7, for which the balance of the rent is due 60 days prior to your Check-In date.  In the event the reservation is made within 30 days of your Check-In date or within 60 days of a reservation between December 18 and January 7, the entire Rent Rate and Fees shall be due at the time of the reservation.

MAXIMUM OCCUPANCY: The maximum number of overnight guests for this Property is limited to ________ persons. 

SMOKING: This is a non-smoking Property. No smoking of any nature is allowed inside of the Property. Any tenant or their guests not adhering to the no smoking policy will be subject to automatic forfeiture of security deposit.

PETS: No pets are allowed at the Property without the express approval of the Owner or as required by law.  In either case, Owner reserves the right to require a reasonable pet deposit.

CANCELLATIONS: A 30 day notice in writing is required for cancellation except for reservations between December 18 and January 7, which requires 60 day notice. Cancellations that are made with less notice than is required by the foregoing sentence will result in a complete forfeiture of the deposit.
 
GUEST/PARTIES/NOISE: The Tenant must supervise their guest(s). Noise in the Property must be kept a reasonable level as not to cause a disturbance to the neighbors or general public. In addition, Tenant must comply with all noise ordinances for the Town of Vail.

MAINTENANCE: Major systems in and around the Property break down from time to time such as heat, washer, dryer, refrigerator, etc. The Owner will attempt to repair the issue as soon as possible upon notice by the Tenant. The Owner assumes no liability to Tenant if such should occur.

SUBLETTING/ASSIGNING/OCCUPANCY: There shall be no subletting of the premises. The Tenant shall occupy and use the premises as a vacation rental only and not use the premises for any business, professional, unlawful or hazardous purpose.

END OF TERM: At the end of the term, the Tenant shall leave the premises clean and in good condition, remove all of Tenant’s property and follow the departure instructions provided to Tenant.

HOLD HARMLESS AND INDEMNITY: The Owner, and any of its representatives and agents, shall not be liable for any damages and/or injury to Tenant and/or their guest(s), or their personal property due to Tenant’s acts, actions or neglect. Tenant agrees to hold Owner harmless against any claim for damage and/or injury due to Tenant’s acts or negligence or their guests acts or negligence.

QUIET ENJOYMENT: Tenant and their guests agree not to violate quiet enjoyment and privacy of the surrounding neighbors. Owner is not responsible for the actions of other property owners in the area, as Owner has no control over their actions.

WEATHER / ACTS OF GOD: Owner is not responsible for any weather conditions or acts of god or nature that happen during Tenant’s stay on premises and no refunds will be made based on such conditions.

UNFORESEEN CONDITIONS: If any unforeseen conditions or problems with the Property arise prior to or during tenant’s stay, Owner  reserves the right to either refund Tenant’s payment pro-rate or place Tenant in a comparable property.

ACCESS: Tenant agrees to allow access to the Property to Owner and its agents upon 24 hours’ notice by telephone or in person. 

KEYS: Access to the Property is provided by key or keypad. Tenant shall return any keys after departure.  Failure to return the set of keys after departure will result in a $15 key replacement fee deducted from the security deposit for each key needing replacement.  Tenant shall be liable for any lost or misplaces keys, parking passes and pool cards.

LAWS: The Laws of the State of Colorado shall apply to all terms under this Agreement. Any dispute under this agreement shall be resolve in Eagle County, Colorado.
