Our space is simple:
The shared living areas on the upper level open to all the light of an enclosed front porch, with two living room sitting areas on either side of farmhouse style table and benches. Also on the upper level is the bathroom with claw foot tub, "mudroom" entry coming in off the side porch, and kitchen. A bedroom is located directly off the kitchen, with a king sized bed and adjoining private bathroom.

Stairs leading down from the enclosed front porch take you directly into an open loft style bunk room. On this lower level there are two bunk beds and a queen bed (which can be separated by privacy curtains, if desired), a full bathroom and laundry area.

Regarding parking at Blue Fox Cottage:
Please do not park on our lawn.
There is room for two vehicles parked in the driveway. There is NO parking permitted on the street, and this is strictly enforced by the Village of Grand Beach. Overflow parking is available at the Grand Beach Village Hall municipal area. If you will have more than two vehicles at anytime during your stay, PLEASE inform us so that we can communicate your license plate information to the Village Officer and you can park in the overflow area without being ticketed.
Guest access
Guests can access everything in the house except for the owner's work room storage space.

Very, very important! Please read:
The Village of Grand Beach Short Term Rental Ordinance requires all rental guests to read the "Village of Grand Beach Rules, Regulations, and Restrictions" document (see below) and be registered with the Village of Grand Beach.

The Village of Grand Beach STR Ordinance holds the hosts/owners responsible for all renters and strictly requires the host/owner to submit the following registration information:
name, age, and phone number of primary renter; names and ages of all other guests.

If the guest rental registration information is NOT messaged to the host at least 48 hours prior to arrival, the reservation may cancelled without refund.

****Village of Grand Beach Rules, Regulations, and Restrictions:

Contact Numbers:
• Police – Emergency situations, always dial 911. To leave a non-emergency message for a Grand Beach/Michiana Officer, call the Grand Beach Police Department and leave a message. Please note, the officer may not respond until the next business day.

Noise Ordinance and Public Disturbance Ordinances:
• No person shall, in any manner, disturb the peace and goodwill of the neighborhood, which includes disturbing neighbors with excessive noise and excessively bright outdoor lighting.

Beach Rules:
• Unattended beach items may not be left on the beach overnight and may be removed by village personnel.
• In order to protect all beach goers, no glass is allowed on the beach and all refuse should be deposited in the garbage containers available at beach accesses. If the garbage containers are full, please carry garbage back home and dispose.
• No dogs on the beach between 11 am and 6 pm (EST) from Memorial Day through Labor Day.
All dog waste must be removed by owner. The State of Michigan requires all dogs to be on a leash even at the beach and all public areas.
• Beach fires allowed with permit only. Permit application available online through the Grand Beach website.

Parking:
• All wheels must be parked off the roadway and not impede the flow of traffic.
• Golf cart parking at all beach accesses require a Village of Grand Beach parking sticker. To avoid a citation, stickers must be affixed to the golf cart.
• Overflow parking for residents is available at the Village Hall.

Garbage and Recycling:
• Garbage and recycling bins should be at the edge of the street, opening facing the street, by 7 a.m. (EST) on Monday morning (Tuesday mornings following Holidays). Garbage is picked up on Monday and Friday July 1 through the week of Labor Day.
• Recycling is on Monday, every other week throughout the year, and weekly from July 1 through Labor Day.
• It is the responsibility of the homeowner to ensure that garbage is placed in secure receptacles and any litter resulting from their refuse is cleaned up in a timely manner.

Fireworks:
• Fireworks are always illegal in the Village of Grand Beach on all public lands and beaches; Fines for any violation are $1,000 per Michigan Law.
• Renters are not allowed to use Fireworks at any time in the Village.

Rental Agreement

This Agreement is entered into with and between Third Coast Vacations (hereinafter referred to as the “Agent") as agent for owner of this vacation rental home and person signing responsible for payment and acknowledgement of this document and payment (hereinafter referred to as the "Guest"), who is responsible for the actions of his/her family and guests.

NOTICE:  BY THE TERMS OF THIS VACATION RENTAL AGREEMENT, THIRD COAST VACATIONS, OWNER, AND THE GUEST ARE INTENDING TO CREATE A PROPRIETOR/LICENSEE RELATIONSHIP AND NOT A LANDLORD/TENANT RELATIONSHIP.

Guest contact info may be transmitted to local homeowner associations and local governments when required.


Guest must provide Agent with their direct email address and mobile phone number that will be available during your reservation upon request as Third Coast Vacation may need to communicate with Guest during their stay.


Guest hereby hires from Third Coast Vacations (Owner’s Agent), for use as a vacationing home, the premises described above for a term commencing on the dates and times described above.  Check-out is made by all persons vacating the property, locking the doors, and either completely locking down the property on site or returning the key(s) to the Third Coast Vacations office at 11 W Mechanic in New Buffalo within 20 minutes of check-out time (when applicable). Failure to check-out at the agreed time may result in a late check-out penalty fee based upon a percentage (25%) of the nightly rental rate .


PAYMENT TERMS


A. Guest shall pay Agent a vacation rental fee that is detailed within the terms of this Agreement.  Guests who book directly are required to provide Third Coast Vacations with a valid credit card number in the event additional charges are incurred during the stay at the property, including but not limited to charges for damages or other violations of this agreement or other applicable local rules and regulations.  Credit cards on file with online booking channel may be sufficient.


Third Coast Vacations may bill Guest for expenses or charge to their credit card for these applicable charges after the Guest’s departure due to information and penalties brought forth after check-out. Agent reserves the right to request a fully refundable security deposit as well.


B. An initial down payment in the amount of 50%(1/2) of the total balance due is required at the time the reservation is made if reserving the home directly with Third Coast Vacations.  Payment terms may be different if using an online reservation channel such as Airbnb, VRBO, or other similar service.  This payment shall be used to secure the use of the Property for the Term and the performance of the Guest’s obligations under this Agreement.  The balance of the Guest Fee shall be due in full four (4) weeks prior to the check-in date above.  If reservation is made less than 30 days prior to check-in then full payment is required.   Third Coast Vacations will automatically charge the remainder of the reservation to the Guest’s credit card on file approximately 30 days prior to their arrival.  If Guest would like to change the payment on file, please notify Third Coast Vacations approximately 35 days prior to arrival to allow time for change to take effect.  Third Coast Vacations will notify Guest by email 5 days prior to final payment processing.


C.  Guest may make payment by check with prior arrangement.  If payment is returned or declined, a $50 fee will be charged for each occurrence.


D. If Guest cancels their reservation at least 30 days in advance, a full refund will be made of your down payment. All cancelations must be in writing and delivered to Agent by mail or email and acknowledged by Agent.


E. In case of major appliance failure, Agent will make every effort to have the major appliances and/ or systems repaired immediately. In the event Agent cannot have repairs effected within a reasonable amount of time, Agent will make accommodations for necessary items. If Property does not meet a reasonable expectation for use and said major appliance cannot be repaired in a short time, then Guest may receive a small refund for inconvenience. Major appliances could include refrigerators, ovens and stoves, HVAC equipment and furnaces.


F. If there is a power outage and Guest vacates the Property early with the permission of Agent, Guest may be eligible for a reasonable refund for the unused rental period. If Guest continues to stay, no refunds will be given and section E and F becomes null and void.


DAMAGE WAIVER


The total rental balance includes a non-refundable damage waiver fee that provides up to $3,000.00 in coverage for accidental damage that occurs during the time delineated in this agreement.  Guest must notify the Third Coast Vacations office within 24 hours when damages occur for the waiver to apply.  Guest is responsible for any and all damages caused by their negligence or intentional acts, and Guest is responsible for damages caused by Guest’s invitees and other occupants as well. Any damage that is found after the guest departs or is determined to be malicious, negligent or due to the use of alcohol, marijuana or any illicit substances will not be covered.  This damage protection does not include The Damage Protection does not cover the guest for soiled or misplaced linens, loss of keys, theft, failure to remove garbage from the property, or leaving the house excessively dirty.  All fees associated with the damage occurring as a result of these actions will be charged to the payment method on file.


If any damages are noted by Third Coast Vacations’ staff upon inspection (and not reported during the stay), Guest agrees to pay the full cost of the repair plus a service charge that will be billed to Guest’s credit card. Guest is fully responsible for damages caused by Guest’s invitees and other occupants.


Guest hereby indemnifies and releases Owner and Agent from any and all liability for personal injury, wrongful death or property damage suffered by Guest which is caused in whole or in part by a latent condition on the Property. Guest understands this Agreement and acknowledges that neither Guest nor his/her heirs, personal representatives or assignees will be able to sue Owner, his/her heirs, personal representatives or assignees for any injury or damages that Guest suffers while on the Owner’s Property due to a latent defect. This provision includes all minors in the Guest’s care while on the Property.


Guest acknowledges all open and obvious conditions of the Property, including the pool, hot tub, golf cart (if any), and all inherent dangers in the existence of these conditions on the Property. Guest assumes all responsibility for caring for and overseeing any minor child who is brought onto the Property. This Property is not child-proofed and Guest agrees to assume all care for minor guest’s safety.


OCCUPANTS


Maximum occupancy is listed on the Third Coast Vacations website and no outside guests are allowed on this property at ANY TIME that would exceed this number without prior arrangements approved by Agent. The primary responsible Guest signing this Agreement MUST occupy the Property with the rest of their party.  Agent has the option to terminate this Agreement or increase the Rental Rate at their discretion for the entire term of occupancy if this clause is violated. Non-approved parties, weddings and/ or any large gatherings that take the Property over occupancy are strictly forbidden without prior approval by Agent and violations of this provision are grounds for immediate eviction without a refund of rental fees or security deposit.


PETS


Dogs may be allowed at this property if explicitly stated in the property listing page or if agreed upon by Agent and Guest in writing.  Cats and other animals are not allowed. There is a fee of $100 per dog for the opportunity to bring your dog to the property.  It is guests responsibility to remove all evidence and waste of the pet on the property prior to departure, both inside and outside of the home. Damage caused by dogs is not covered under the Third Coast Damage Waiver policy, Guest is responsible for cost of repairs and possible extra housekeeping.  If evidence of an unapproved pet of any kind is found at the property at any time and the pet fee was not paid prior to arrival, a $500 may be charged to Guest and/or Guest may be asked to leave.


SERVICES AND RESPONSIBILITIES AND OWNER, AGENT AND GUEST


 A. If Internet access is provided, it is not unusual for unexpected interruptions or outages to occur. These are beyond our control and there will be no discounts or refunds due to interruptions in internet service.  Agent is not responsible for assistance in connection of guest devices to property internet access.


B. Cellular telephone service in Southwestern Michigan can be spotty depending on location, carrier and specific cell phone. If the property has a land line, the Guest is responsible for all long distance or toll charges incurred while occupying the Property. Guest agrees to a $20.00 service charge plus the cost of any long distance or toll charges that will be billed to the credit card.


C. If cable or satellite television is provided, Agent and Owner are not responsible for any unexpected interruptions that are beyond our control. No discounts or refunds shall be given for interruptions in service or defective provider devices. The Guest is responsible for all Pay Per View charges incurred and Agent has the right to apply this to the credit card on file. Guest agrees to a $20.00 service charge plus the cost of the purchased movies.


D. A $50.00 charge may be applied to the Guest’s credit card for lost keys, beach or pool passes and/or lockout situations.


 E. Housekeeping and Maintenance: Before departure, Guest will perform the following: 1) Please wash all dishes 2) Clean and empty outdoor grill, fire pit and fireplace(when applicable) 3) Take trash to outdoor cans 4) Replace indoor and outdoor furniture to original locations. Failure to comply may result in additional cleaning charges billed at $50.00 per hour. Where available, fireplaces are available for seasonal use during cold weather months only without prior approval.


F. Violations/Disturbances: Guest understands and agrees that the primary responsible party signing this agreement must be a responsible adults over the age of 25.  Guest also agrees that the premises shall not be occupied by more than the number of people stated in this Agreement, and the number of cars parked on site shall not exceed the number stated in the  FAQ section of the web page for this specific property.  If the property is occupied by more than the number of people stated in the Agreement or if too many cars are at the property, an additional fee may be charged at Agent’s discretion. 


G. Guest and all other occupants may be required to vacate the property immediately with complete forfeiture of rental costs and/or security deposit (if applicable) for any of the following violations:  1) Use of property for any illegal activity, including but not limited to, the possession, serving or consumption of alcoholic beverages by or to any person less than 21 years of age; 2) Consumption or use of any illegal substances; 3) Loud music and/or disruptive behavior; 4) Causing damage to the property or to any neighboring properties; 5) Any acts which may interfere with the neighbors’ quiet enjoyment of their property, beach or neighborhood, including but not limited to the discharge of firearms of fireworks.


H.  Third Coast Vacations assumes no risks for the use of pools and/or hot tubs located on the property. Diving or jumping into the pool or hot tub may result in head, neck, or spinal injuries. The renter accepts all risk of the pool or hot tub and specifically agrees that no minor under the age of 18 will enter the pool or hot tube unless accompanied by an adult. Community or condominium pools or hot tubs are not controlled or maintained by Third Coast Vacations, and Third Coast Vacations cannot be held responsible for any inconvenience resulting from the pool or hot tub. Pools and hot tubs have electrical/mechanical components. These components can sometimes malfunction. Third Coast Vacations, its Vendors, and the Homeowner cannot be held responsible for any malfunctioning pool or hot tub. Please inform us as soon as possible if the pool or hot tub is not working properly. No compensation will be given for a malfunctioning heater. Third Coast Vacations will do everything in its power to rectify any problems with malfunctioning equipment as quickly as possible.


Guest and their occupants shall comply with all statutes, ordinances and requirements of all municipal, state and federal authorities now in force, or which may hereafter be in force, pertaining to the use of the Property.  This includes homeowner’s association rules which will be provided by Agent where applicable.  This can also include rental requirements and / or ordinances which are in effect from a town or township the property is located


 As long as Guest performs all the covenants and conditions of this Agreement, he/she shall have peaceful and quiet enjoyment of the Property for the term stated herein. Quiet hours are 10:00 PM local time to 8:00 AM local time for the Property, the beach, pool and all outdoor areas where applicable.


MISCELLANEOUS PROVISIONS


A. Agent reserves the right to enter the Property at all reasonable hours of the day for the purpose of inspection, cleaning, or to make repairs, with advance notification given to Guest in advance whenever reasonably possible. Agent also reserves the right to enter immediately at any time during exigent or emergent circumstances.


B. Assignments of this Agreement are not allowed without the prior written consent of Third Coast Vacations.


C. If an action is brought under this Agreement by reason of a breach of any provision in this Agreement, the successful party shall be entitled to attorney’s fees and cost.


D. One or more waivers of any provision or condition of this Agreement by Third Coast Vacations shall not be construed as a waiver of any other provision or condition. Waivers must be in writing.


E. This Agreement sets forth all the promises, agreements, conditions and understandings, either oral or written, between Agent and Guest that are not herein set forth. No alteration, amendment, change or addition to this Agreement shall be binding upon either party unless reduced to writing and signed by each party.


F.  If any clause, phrase, provision or portion of this Agreement shall be invalid or unenforceable under applicable law, such event shall not effect, impair or render invalid or unenforceable the remainder of this Agreement.


G. Agent shall not be responsible for loss of personal property by Guest, occupants, and/or visitors during Guest’s stay on the Property. It is the Guest’s responsibility to secure the Property against theft or loss during the rental form. If lost items are found and returned to Guest there will be a reasonable handling fee added to the actual shipping cost.


H. This Agreement shall be governed by and construed in accordance with the laws of the State of Michigan. Venue for any legal action to enforce or interpret this Agreement shall be in Berrien County, Michigan. Guest and their invitees must comply with all applicable laws, codes and ordinances.


J. Fireworks are NEVER allowed at any Third Coast Vacations rental properties and are subject to the terms of the Violations/Disturbances paragraph stated above. 


K. When allowed, beach fires are to be monitored at all times, and must be completely out with all debris completely removed after each use. Fire pit use is allowed in designated or pre-approved areas only, and is subject to seasonal and conditional restrictions.


L. Beaches shift and change sizes every year, sometimes in as little as 24 hours. Agent cannot be held responsible for erosion caused by weather and beach conditions or access are not promised. No refunds or discounts will be issued. {i*:sR:____}


M.  SMOKING OF ANY KIND IS NOT ALLOWED INSIDE THIS PROPERTY. THIS INCLUDES MARIJUANA. Property is a non-smoking home. Guests are welcome to smoke on the outside deck as long as cigar/cigarette butts are properly extinguished and then properly and safely disposed of in the garbage - NEVER throw butts/matches in the yard). Failure to comply may result in immediate termination of this agreement, forfeiture of security deposit and rental fee in case of eviction, and you will be held responsible for all associated costs and repairs for violation of smoking rules.


N. Lake and beach conditions can change rapidly, it is Guest’s responsibility to monitor and assess beach safety and to be aware of any governmental access restrictions or safety warnings.  


O.  You may be asked for further agreement and acknowledgement of any homeowner association requirements / bylaws if you are staying within an association and/or local ordinances may require information to be forwarded to local governing entity and acknowledgement of local rules pertaining to renting a property.  You may be required to provide names, ages, car identifications, etc, for their files.  


P.  If any fines are assessed by an association or local entity for violations and forwarded to Third Coast Vacations after departure, Third Coast Vacations will inform guest and has authorization to run payment for the assessed fees.  Any fines will be transmitted to guest for notification prior to charging guest.


Q.  If you are reserving the home through an online travel agency such as Airbnb, VRBO, Booking.com, Google, Hometogo, or other similar online reservation channel, Third Coast Vacations does require a signed electronic version of the rental agreement.  Third Coast Vacations does have the right to cancel the reservation if this is not completed within 7 days of reservation confirmation.
