When John Clemons began managing vacation rentals in 2011, he didn’t copy everyone else. Instead, he started fresh and drew from his background in engineering – where every detail matters – and took a process-oriented approach to figure out how to do things better.

Taking that approach has paid off. SHORT TERM RENTAL AGREEMENT 

This Short Term Rental Agreement (the “Agreement”) is

made by and between (“Homeowner”) and the above listed “Traveler,” (“Tenant”) as of

the date first payment is received. For good and valuable consideration, the sufficiency of which is

acknowledged, the parties hereby agree as follows:

1. Property: The property is located in Flagstaff or Sedona areas. The property is fully

furnished and includes dishware, linens, and towels.

2. Maximum Occupancy: The maximum number of occupants (Tenants plus any additional guests)

is limited at each property, unless prior written approval has been obtained.

3. Term of the Lease. Check in anytime after 5:00 P.M. on the “Check In” date listed above, and

check out is anytime before 10:00 A.M. on the “check out” date listed above.

4. Rental Rules: Tenant agrees to abide by the Rental Rules attached as Appendix A at all times

while at the property and shall cause all members of the rental party and anyone else Tenant

permits on the property to abide by the following rules at all times while at the property.

5. Access: Tenant shall allow Homeowner or his appointees access to the property for purposes of

repair and inspection. Homeowner shall exercise this right of access in a reasonable manner.

6. Insurance: Tenant is encouraged to purchase traveler insurance.

7. Payment: Payment shall be made in accordance with the “Payment Schedule” set at time of booking.  There is a 3% payment processing fee which may be deducted from the security deposit. E-checks are exempt from payment processing fee. Returned Checks subject to $35 fee. Payments not paid in full on or before their due date may result in reservation being cancelled, loss of all payments made, and loss of security deposit.

8. Cancellation Policy: Cancellations or early departure by guest do not warrant any refund of rent or deposit.

9. Counterparts: This Agreement may be executed in counterparts, each of which shall be deemed

to be an original, but all of which, taken together, shall constitute one and the same Agreement.

10. Security Deposit: If the Premises are returned to Homeowner at the termination or expiration of

this Agreement in a clean and undamaged condition acceptable to Homeowner, Homeowner shall

return the Security Deposit to the Tenant within 14 days of Tenant’s departure. If there is any

recognition of damage or the premises is excessively dirty, it shall be reported to Tenant in writing

within 14 days of Tenant’s departure. The report will specify what damage is observed and what

costs are associated with repair that will reduce the amount returned to the Tenant of the Security

Deposit. 

 


The parties agree to the terms of this Short Term Rental Agreement, as evidenced by the

signatures set forth below and/or by the electronic acceptance of this agreement. Homeowner: See "Homeowner" above

Tenant: See “Traveler” as listed above.

Appendix A RENTAL RULES

1 Smoking: Smoking is NOT allowed on the property.

2 Guests: People other than those in the Tenant party as agreed upon may not stay overnight on

the property. Any person on the property is the sole responsibility of Tenant.

3 Liability: The homeowner or his appointees are not responsible for any accidents, injuries or

illness that occurs while on the premises or its facilities, nor are they responsible for the loss of

personal belongings or valuables of the tenant. By accepting this reservation, it is agreed that all

tenants are expressly assuming the risk of any harm arising from their use of the premises or

others whom they invite to use the premise.

4 Condition of the house Tenant is responsible for keeping the property and all furnishings in good

order.

5 Appliances Only use appliances for their intended uses.

6 Pets Pets are permitted only with prior approval and a paid pet fee. All pet waste must be

disposed of properly, and pets must be kept on a leash in accordance with Coconino County and Flagstaff City

Ordinances.

7 Parking: Vehicles are to be parked in designated parking areas (driveway and garage) only.

Parking on the road is not permitted. Any illegally parked cars are subject to towing; applicable

fines/towing fees are the sole responsibility of the vehicle owner.

8 Housekeeping: There is no daily housekeeping service. While linens and bath towels are

included in the unit, daily maid service is not included in the rental rate. We do not permit towels or

linens to be taken from the house. Upon checkout, tenant agrees to pay for final cleaning of the

house, above and beyond prepaid “cleaning fee,” if necessary.

9. Utilities: Please be environmentally responsible when using utilities. Excessive use of utilities

may result in loss of deposit.

10. Fireplace: Tenant is responsible for opening/closing flue vent and keeping the fireplace free of

ash.

11. Storms: Mountain roads coming into Flagstaff can be curvy and steep. Snow may be present

on roads and on property. Snow removal is the responsibility of the Tenant. No refunds will be

given for storms. We highly recommend four wheel drive and/or chains during snowy conditions.

We do not refund due to road conditions.

12. Damage: Tenants are responsible for any damage the the property caused by themselves,

pets, or any visitors or guests.

13. Speed Limit: The neighborhood is a residential area with many children,

pets, and elderly. Tenant must drive courteously and safely, and shall not exceed posted speed

limits when driving within the neighborhood.

14. Motorized Off Road Vehicles: Tenants are not permitted to use any motorized off road vehicles

on the property, or on any of the neighborhood roads.

15. Noise, gatherings, and parties: The home is in a very quiet and peaceful residential area,

please respect the neighbors by keeping outdoor noise to a minimum. No gatherings or parties are

permitted at the house without prior written approval.

16. HOA: Guests are required to abide by all rules of the HOA.
