ATLANTIC VACATION HOMES RENTAL AGREEMENT  Upon receipt of this signed contract, Atlantic Vacation Homes requires an initial payment of half of the booking total, including taxes and fees. The balance of the rent must be paid 60 days prior to occupancy. If you wish to change your form of payment, call the Atlantic Vacation Homes office before the second payment is due. Payment can be made by check, e-check, cash and credit card (Visa, MasterCard and Discover). If the reservation dates are changed, at the GUEST's request, Atlantic Vacation Homes may charge an additional $100 (plus tax) change fee in addition to any changes to the base rental rate.  

USE AND OCCUPANCY GUEST shall be granted a Use and Occupancy Agreement to come upon and have the use of the property referenced above. 

Occupancy: The occupancy limit stated on the Agreement and in the listing may not be exceeded without express written permission of Owner or Agent. Children are counted in total occupancy unless they are under the age of two. No campers or motor homes can be parked on the rental property for the purpose of adding extra sleeping space.  Atlantic Vacation Homes has strict occupancy and parking limits at each home. Please make sure you plan accordingly.  In the event that this Agreement, along with the monies, are not received by the above dates, then this Agreement shall be considered null and void, and the initial deposit shall be forfeited. If the rental property becomes unavailable during the agreed to dates, AVH Realty, Inc., will provide Guest with a comparable property or will refund the payments made. 

Properties are for residential use only. Parties, gatherings and events consisting of groups exceeding the maximum occupancy are subject to approval in advance of the rental period and, if approved, may incur additional fees. Violations may result in additional charges or fines. 

Fireworks are illegal in Massachusetts and may not be launched from this property.

PETS No dogs, cats or other animals may be kept in or upon the premises without the specific written consent of Atlantic Vacation Homes. Please note that not all Atlantic Vacation Homes properties allow pets. Please do not bring pets onto any property without explicit approval.  If approved by Atlantic Vacation Homes to bring a pet, GUEST agrees to clean up after pet both inside and outside the house and obey local leash laws. GUEST responsible for any damage done by pet to house or yard. Whenever possible please have pets use areas off of lawn areas to preserve the grounds. OWNER and Atlantic Vacation Homes are not responsible for any harm or injury to and/or caused by dog that may occur during The Agreement term. GUEST is responsible for any costs incurred by any remediation necessary to remove fleas/ticks that may be brought into the property by your pet. Upon signing this Agreement, GUEST agrees that said pet(s) are being treated for the prevention of any pest infestation. GUEST agrees that pet(s) are prohibited from going on furniture and beds.     

RENTAL TERMS AND CONDITIONS 

Cancellation Policy (Vrbo Relaxed):  100% refund 14 days before check-in; 50% refund 7-14 days before check-in. 

GUEST Agrees To: leave the premises in the same order, state of repair, and cleanliness as found; to not bring or keep pets without payment of pet fee(s) and prior approval from Atlantic Vacation Homes and Owner; to use credit / calling card or cell phone for all long-distance calls; depart by 10:00 AM, to leave keys where found upon arrival; and not exceed the maximum number of people for sleeping accommodations provided. If more than the above-numbered persons are found to occupy the unit, the Agreement shall be immediately revoked. If excessive cleanup of the unit is required, additional charges for linens and cleaning service shall be levied against GUEST. Such determination will be made at the discretion of Atlantic Vacation Homes. Parties over may be charged an additional fee. GUEST is responsible for conduct of their guests and all terms apply to visitors of GUEST. OWNER OR AGENT MAY INSPECT THE PREMISES AT ANY TIME WITH REASONABLE NOTICE.  

Rental Period: GUEST is required to check-in after 4:00 p.m. and check-out by 10:00 a.m. so that the property can be readied for next guests. The GUEST's credit card on file will be charged a minimum fee of $75 plus tax if they fail to depart by 10:00 am or arrive before 4:00 pm without prior explicit written approval by Atlantic Vacation Homes. Damage Fee: Atlantic Vacation Homes charges GUEST a non-refundable damage fee. The damage fee covers a maximum of 10 times the amount of the fee (for example, a damage fee of $100 covers up a total of $1,000 of accidental damage per rental). The GUEST shall be responsible for damage exceeding the covered total. Reasonable costs of collection, including attorney's fees, if necessary to collect same will also be the responsibility of the GUEST. GUEST must report any loss or damage to the unit or its contents to Atlantic Vacation Homes staff within 24 hours after its occurrence or this damage will not be covered. Staff will have the sole authority to determine the extent of repairs necessary. Representatives of Atlantic Vacation Homes have ultimate administrative authority. Arbitration is required prior to litigation. The prevailing party in any arbitration or litigation shall be entitled to recovery and/or reimbursement of all fees in connection with same. The damage fee does not cover: charges for excessive cleaning; long distance calls; acts of God; intentional acts of GUEST; gross negligence or willful conduct; any cause, if GUEST does not report the damage to Atlantic Vacation Homes staff by the time they check out of the unit; normal wear and tear; damage or loss caused by a pet or other animal brought to the premises by GUEST; fee applies only to the direct physical loss or damage to covered property. It does not cover loss of use of such property; loss or damage to any property owned by or brought to the premises by GUEST. The damage fee policy becomes effective upon check-in to an Atlantic Vacation Homes unit. All benefits terminate at the end of documented stay.   

Security Deposit: In most circumstances, Atlantic Vacation Homes does not collect a security deposit on rentals less than ninety days. 

Noise, Construction, Traffic, or Other Inconveniences: Refunds, discounts, substitutions, or cancellations cannot be made due to nearby construction projects, traffic, neighboring properties, insects, or any other circumstances beyond our control.  

Furnishings: All vacation rental homes are furnished and equipped with, but not limited to, sheets and bath towels, pillows, bedspreads, blankets, pots, pans, dishes and flatware unless otherwise stated. GUEST may not rearrange the furniture.  

Smoking: Smoking and vaping of any sort are not permitted on the premises any Atlantic Vacation Homes rental property. If it has been discovered that smoking has occurred in, on, or around the property, GUEST's credit card on file will be charged a minimum $500 fee.  

Cleaning: Property will be prepared and cleaned before GUEST arrival. GUEST agrees to leave property neat and tidy (broom clean), with the dishes and cookware washed and put away, and trash/recyclables removed from the property or placed where directed. Arrangements can be made for cleaning service, during the rental period, for additional fee. If extraordinary cleaning is required post-departure, a minimum Excess Cleaning charge of $250 will be charged to your account. If excessive trash is left at the property, a minimum Excess Trash fee of $50 will be charged to your account.  

Items Left Behind: If a valuable item is left at a rental property, Atlantic Vacation Homes will pick up the item(s) and bring them to our office for pickup and mailing, if necessary. Guest will be responsible for payment of postage.  

Telephones: Many properties do not have landlines and usually have long distance blocks. Local calls are free. Please use calling / credit cards or cell phone for long distance calls. Bring your cell phone. Please note that cell service can be spotty in certain areas.  

Maintenance: All items in the homes are furnished by the owner and are expected to be in good working order. Atlantic Vacation Homes is not responsible for the condition or malfunction of the equipment. However, Atlantic Vacation Homes will use best efforts to arrange for timely repairs.  

Mail and Packages: Please do not have mail or packages sent to your vacation rental property. If you anticipate needing to receive mail or packages during your stay, please contact us to have items sent to our office instead. We are not responsible for lost mail or any items sent to the property. 

SAFETY WAIVER  
GUEST hereby acknowledges, on behalf of myself, my family members, and invited guests that, as a condition to the privilege of being granted access to the house and grounds of my rented property we, and our representatives, release and agree not to make or bring any claim of any kind against the homeowners, Atlantic Vacation Homes, or their representatives, employees, agents, successors, and assigns, for any injury or harm, to us, our family members, invited guests, or our property that may arise out of or be related to the use of any area, whether from negligence or any other cause, including the home, decks, ocean/river, docks, grounds, or equipment. Guests are expected to be respectful of the needs, rights, and privacy of neighbors at all times. 

Waterfront and Swimming Pool Areas 
By signing this form, you fully understand that waterfront areas may include swimming pools; docks; stairs; rocks and/or cliffs; changing tides and/or currents; boat traffic; channels; sandbars; or sea walls, all of which are inherently dangerous and you agree that the use of all facilities and equipment shall be at your own risk. Guests assume the responsibility and liability for themselves as well as their visitors and guests at the pool or waterfront and recognize the absence of a fence around the oceans, rivers, or other natural bodies of water, and agree to be aware of and explain the dangers of changing weather conditions, the changing and variable tides and how they affect the sandbars, channels, and currents. 

Docks, Decks, and Stairs 
No running, rough play or jumping off any pool deck, sea wall, stairs, docks, ramps, or rocks is allowed. 

Recreational Activities and Equipment 
Swimming or use of kayaks, boats, pool accessories, or other outdoor recreational equipment, will be at the sole risk of the Guest. If you are using Atlantic Vacation Homes boating equipment, use of lifejackets is required. Children Children will have adult supervision at all times throughout the property, both inside and outside the home, including stairs, decks, grounds, and all aspects of the water, including swimming pools, docks, rocks, and sandbars.
