• Please be mindful of electricity use during your stay. There is a $450 monthly cap. Anything over the $450 monthly cap will be the responsibility    of   the guest. 
• One assigned driveway parking space. Public parking or street parking is not available in this community. If you arrive with a vehicle that does not fit into the assigned parking space, you might be turned away and not allowed to check in.

TERMS AND CONDITIONS

The following Terms and Conditions are an integral part of this Vacation Rental Agreement. The individual booking this reservation (“you” or “Guest”) must carefully review this entire Vacation Rental Agreement, including these Terms and Conditions, before the reservation can be confirmed.

RATES AND OCCUPANCY: Rates are quoted on a per-night, per week, or per month basis as noted. Unless specified, check-in time is after 4:00 p.m. on the day of arrival, and checkout time is 10:00 a.m. on the day of departure. Rates are based on the number of occupants listed on page 1 of the Vacation Rental Agreement. You may be subject to additional charges for any additional occupants who are not listed on page 1, and if the total number of overnight occupants exceeds the maximum overnight occupancy limits for the Property, you will be required to make alternative arrangements for any occupants in excess of the limit. Rates vary and are subject to change without notice. 

ADDITIONAL CHARGES: Rates do NOT include daily maid service (unless noted), gratuities, car rental, food, liquor, laundry, personal items, excessive cleaning upon departure (e.g., upholstery or rug shampooing, etc or damage beyond normal wear and tear.).

RESERVATIONS AND PAYMENTS: Payment of the applicable Rental Deposit amount together with a completed Vacation Rental Agreement must be received and acknowledged by Beach Property Realty, LLC (the “Company”) on behalf of the Owner before a confirmation can be issued. No grace period will apply. Final payment is due of the remaining balance at least sixty (60) days prior to the scheduled arrival date, or if booked with less than sixty (60) days remaining prior to arrival, at the time of the initial reservation. Failure to deliver the final payment on a timely basis will make the reservation subject to cancellation, and the Rental Deposit may be applied pursuant to this Vacation Rental Agreement. The Company assists the Owner in the marketing and management of the Property and serves as the Owner’s local on-island agent for the Property.

CONDITION OF RENTAL: The Property shall be in the same overall condition upon the Guest’s departure as it was at check-in, normal wear and tear excepted. The Owner and/or the Company may enter the Property at reasonable times to make repairs or provide maid service (if applicable). The Guest may only cook in areas specifically designated for cooking. The Guest must immediately notify the Owner and/or the Company of any fire or other damage to the Property. The Guest shall be liable for all acts of the family, invitees, employees, or other persons invited into the Property. The Guest may not sublet or assign this Vacation Rental Agreement under any circumstances. The Guest shall be responsible to return all keys, fobs & remotes upon departure (there is a $50 fee per lost key, fob or remote that is not returned at the end of the Guest’s stay). The Guest shall abide by the House Rules of the Association of Apartment Owners of the Property (the “AOAO”) as  provided to the Guest. The Guest shall not bring any pets into the Property. Smoking is not permitted in the Property or on any of the grounds of the Project except in the designated smoking area(s). If the Guest or any occupants of the Property during the Guest’s rental period violates the no-smoking rules of the Project, the Guest will be subject to fines as assessed by the Manager. If any smoking occurs inside the Property itself, the Guest will be charged a $500 minimum fee, to be deducted from the Security Deposit, to recondition the Property and remove the smoke odor. No catering or outside music permitted without prior consent and a valid reservation for the Member’s Lounge; additional charges may apply. The Guest shall not permit any use of pool or Jacuzzi by unsupervised children or any person who is not listed on page 1 of this Vacation Rental Agreement and shall keep gates at the Project closed at all times when not in use. All authorized users shall use the pool, jacuzzi, and fitness center at their own risk. The Guest understands that there are certain inherent risks to persons and property located adjacent to the ocean, including the possibility of drowning. The Guest acknowledges that the Owner would not rent the Property to the Guest unless the Guest (and all occupants of the Property during the Guest’s rental period) accepted this condition and that there are no lifeguards or other safety services provided at the Project’s pools and/or the lagoons located at the Resort.

SECURITY DEPOSIT: As part of the reservation process, the Guest is responsible for damages to and/or loss of items from the Property. The Damage & Security requirements of the Owner shall be satisfied by the Online Travel Agent (OTA) as described by the terms and conditions of the OTA’s policies if damage or loss occurs. In addition, a $50 Damage Waiver is added to each reservation to provide a primary coverage of up to $1,000 in protection for damages not filed with the OTA’s coverage during that guest’s stay. In the event of a claim under the OTA’s protection policy, Company, on behalf of the Owner is authorized to work with OTA or the damage waiver to correct or repair losses. Examples of loss coverages may be, but are not limited to: the payment of any and all unpaid amounts due from the Guest; fines incurred due to violations of the House Rules during the Guest’s stay; additional departure cleaning expenses (e.g., stained carpets, and/or upholstery, stained or damaged towels and linens, walls, appliances and removal of odors from smoking, etc.), excessive trash left in the Property; and restoring the Property and its contents back to the condition it was in prior to your arrival. If the Security Deposit, coverage or online travel agent’s coverage is insufficient to cover such costs, you must promptly pay any additional amounts due upon receipt of an invoice from the
Owner or the Company. Lost or damaged keys are not covered by these damage deposits and are the direct responsibility of the tenant to return all issued keys, fobs and remotes. Lost or damaged keys will result in a charge of $50 per lost/damaged key.

LIMITATION OF LIABILITY: The Company acts as a marketing resource for the Owner and assists the Owner in providing Guests with a uniform resort like experience. Under no circumstances shall the Company or the Owner be responsible for any loss, expense, damages, claims or injury direct, indirect, consequential or otherwise whatsoever, howsoever caused or incurred whether arising in contract or otherwise in law or equity as a result of rendering of the services or accommodations as described or substituted and including, without restricting the generality of the foregoing as a result of any delay(s), substitution(s), rescheduling(s) or change(s) in the provision of services or amenities as determined by the AOAO through the Resort Manager, the Ko Olina Resort Association, or by military actions, revolution or acts of God, government agencies, epidemics and/or pandemics, or any other unforeseen circumstances or events, by any agents, owners, employees, subcontractors, servants or services as substituted. The Company and the Owner at all times will act in good faith and use commercially reasonable efforts to provide the Guest with replacement accommodations or services of a type comparable to those described in this Vacation Rental Agreement, but neither the Company nor the Owner will be liable under any circumstances to refund any unused portion of the Guest’s payment for booked accommodations or services. Guest acknowledges and agrees, for the Guest and on behalf of all guests, family members, invitees, employees, and other occupants who will occupy the Property at any time during the Guest’s rental period (whether or not named on page 1 of this Vacation Rental Agreement), that each such person is voluntarily participating in any and all activities, risks, and use of the Property, the Project, and the Resort, and hereby assumes all risk of injury, illness, damage or loss to person and property that might result, including, without limitation, any loss or theft of personal property. By booking your stay in the Property, you acknowledge that in all events and circumstances, the Company and its officers, members and employees, and Owner shall not be liable. The Company, as the Owner’s representative, reserves the right to gain consent from the Owner to cancel or rescind the Vacation Rental Agreement the Company determines that you or any of the occupants of the Property during your rental period are conducting unlawful activities, not abiding by the AOAO’s House Rules, disturbing others by playing loud music, percussion, audio or instruments or causing any loud or offensive noises, have made any misrepresentations about the nature or size of the group occupying the Property or their use of the Property, or are in breach of this Vacation Rental Agreement.

NOTICE OF ABSENCE: You must notify the Company in writing in advance if you will be absent from the Property for 5 consecutive days or more. If you fail to provide the required notice, then you will be deemed to have abandoned the Property. In such event, the Company may immediately terminate this Vacation Rental Agreement and retake possession of the Property, and all amounts that you have already paid under this Vacation Rental Agreement will be deemed fully earned and non-refundable.

HOLDOVER, ABANDONED POSSESSIONS AND SERVICE OF NOTICES: If you stay in the Property after the term of this Vacation Rental Agreement has ended without either the Owner’s or the Company’s express prior written consent, you will be deemed a “holdover tenant” and may be liable for twice the rent being collected under this Vacation Rental Agreement on a prorated daily basis for each day you are a holdover tenant. If you leave any personal property in the Property that the Company determines to be of value (in the Company’s sole and absolute discretion), then the Company will contact you in writing at the address listed on page 1 of this Vacation Rental Agreement. If you do not respond within 20 days after the date of such notice, then you will be deemed to have abandoned the personal property, and the Company may advertise such items for sale or donate them to a charitable organization.

CHANGES TO BOOKINGS: An additional $100.00 administrative fee may be charged by the Company for any change to a booking after a reservation confirmation has been issued. Acceptance of any change is subject to approval by the Company and the Owner. INSURANCE: The Owner’s and the Company’s insurance policies for the Property do not cover your personal belongings or any damage that you or any occupants of the Property during your rental period may cause. You agree that each of the Company, Owner, and the AOAO is not responsible for any loss or damage to your personal property during the term of this Vacation Rental Agreement. You acknowledge it is your responsibility to carry your own insurance covering all of your property located in the Property and that the Guest bears full responsibility for any damage to the Property or its contents during Guest’s rental period, including damage from fire, water, theft, or any other causes.

CANCELLATION AND REFUNDS: Cancellations requested in writing at least 60 days prior to the scheduled arrival date are eligible for a full refund. Any cancellations requested less than 60 days prior to the scheduled arrival date may be subject to forfeiture of the entire rental amount paid. A full refund will be made under the following circumstances: (1) if, on the day that the rental is scheduled to begin, the Property is physically unfit for habitation and no equivalent substitute accommodations can be provided to the Guest; or (2) if the Guest is unable to reach the Property by any of the usual means of transportation to Oahu for the entire rental period or access to the Property by visitors has been completely prohibited by governmental authorities. To protect against cancellations caused by certain unforeseen events, such as illness, death, natural disasters, or any  unplanned events, the Company strongly recommends that the Guest purchases travel insurance and/or trip interruption protection tailored to the Guest’s circumstances and existing conditions.


CATASTROPHIC EVENTS and EMERGENCY EVACUATIONS: If a catastrophe (hurricane, tornado, earthquake, flood, public health and safety proclamation, etc.) or any event beyond the reasonable control of the Company and/or the Owner prevents you from using the Property, neither the Company nor the Owner shall be responsible for finding alternate lodging for you or for any of your financial losses related to transportation or alternate lodging. There will be NO REFUNDS OR CREDITS FOR EMERGENCY EVACUATIONS. Please consider travel protection insurance to secure your vacation investment and eliminate your financial risk.

DISCLOSURE OF LICENSED REAL ESTATE BROKER OWNERSHIP: Beach Property Realty, LLC and/or Michael Hege’, R, Principal Broker and sole member of Beach Property Realty, LLC, is a licensed real estate broker in the State of Hawaii and has an ownership interest in the following Propertys at the Project Beach Propertys at Ko Olina: OT 801, BT 702, OT 301, OT 621, OT 711, BT 805 and OT 302.

DISCLAIMER: Ko Olina has been an active market and will be experiencing additional development in the coming years. Although specific dates are yet to be released, traditionally, construction has taken place on weekdays between 7:30 AM-5:00 PM, subject to change. Neither the Company nor the Owner has any control over the availability of access to the Ko Olina lagoons or other amenities of the Resort.
