Terms and Conditions
IDENTIFICATION:
The Renter of the property is hereinafter referred to as the Guest.
The Rental Manager is Florida Vacation Connection hereinafter referred to as FVC.
The Owner of the vacation rental property is hereinafter referred to as the Homeowner.
1. VACATION RENTAL DAMAGE PROTECTION. As a part of your stay, you may purchase a
Vacation Rental Damage Protection plan designed to cover unintentional damages to the rental unit
interior that occur during your stay provided they are disclosed to management prior to check-out. If
purchased, the policy will pay a maximum benefit of $3,000. Any damages that exceed $3,000 or are
not covered under the plan will be charged to the credit card on file. If, during your stay at one of our
rental properties, an insured person causes any damage to real or personal property of the unit as a
result of inadvertent acts or omissions, the Insurer will reimburse the Insured for the cost of repair or
replacement of such property up to a maximum benefit of $3,000. Certain terms and conditions apply.
The Vacation Rental Damage Protection can be purchased up to, and including at, check-in. By
submitting payment for this plan, you authorize and request Customized Services Administrators, Inc.
d/b/a Generali Global Assistance & Insurance Services to pay directly Florida Vacation Connection
any amount payable under the terms and conditions of the Vacation Rental Damage. Please contact
Florida Vacation Connection directly if you do not wish to participate in this assignment.
2. REFUNDABLE SECURITY / DAMAGE DEPOSIT. If you decide against purchasing the above
Vacation Rental Damage Protection, a refundable damage deposit will be added to your final balance.
The damage deposit will be returned 30-60 days after your departure date. Deductions from the
damage deposit may include, but are not limited to: damage to the property and/or inventory, excess
departure cleaning or laundry, electric overage if applicable, private pool heating expenses, and any
other fees and charges as set forth in this Reservation Agreement.
3. TRAVEL CANCELLATION INSURANCE. By purchasing travel insurance, you can be covered for
non-refundable deposits, cancellation penalties, as well as gain access to traveler’s assistance
services.
4. CANCELLATIONS. Advance Deposits paid will be forfeited unless written notice of cancellation is
received by FVC at least 120 days prior to the arrival date on Reservation Agreement. If guest cancels
within 120 days of scheduled arrival, Guest will forfeit all monies paid unless the property is re-booked
for the full term. If the property is re-booked for full term, Guest will receive a refund of 75% of the
funds recovered. All cancellations are subject to a $300.00 cancellation fee. Partial cancellations will
not be accepted. Adjustments or refunds for a late arrival or early departure will not be made.
5. CHANGES TO RESERVATION AGREEMENT. Should Guest request a change of date or
accommodation or any other change to said Agreement and FVC is willing and able to facilitate this
change, Guest shall incur a $100.00 administrative change fee.
6. FURNISHINGS AND INVENTORY. All rental properties are individually owned and are furnished
and decorated to the Homeowner’s individual style. All rental properties meet FVC’s minimum
inventory requirements. Furnishings and inventory are subject to change without notice. Neither FVC
or the Homeowner are responsible for providing additional furnishings or inventory not presently
available in the property. No refunds will be given should the rental property not meet Guest
expectations or preferences.
7. SUBSTITUTION OF ACCOMMODATIONS. Should circumstances beyond our control cause
Guest confirmed accommodations to be unavailable prior to Guest arrival, FVC reserves the right to
substitute comparable accommodations, if available. Confirmed rates in these instances cannot be
guaranteed. Substitute accommodations and rates will be subject to Guest approval. Upon notification
by FVC that such a move is necessary, Guest will have the option to accept a substitute
accommodation, if available, or cancel Reservation Agreement with no cancellation penalties.
8. PROPERTY LISTED FOR SALE. Should Homeowner sell their property, FVC will do its best to
ensure that Guest reservation be honored by the Buyer; however, FVC cannot guarantee Buyer will
accept reservation. If Buyer will not accept reservation, FVC will offer Guest an alternative property if
available or issue a full refund. Guest is under no obligation to accept alternative property and may
cancel for a full refund. FVC cannot guarantee the cost of alternative property. If cost is lower, the
difference will be credited to Guest. If cost is higher, Guest will have the option to accept and pay the
increase or to cancel for a full refund.
9. KEY CONTROL. Upon check-in, property keys, garage door openers and gate cards (if applicable)
become the responsibility of Guest. If any of these are lost or not returned making it necessary to rekey, or to obtain additional openers, cards or keys, then a minimum $50.00 fee will be charged to the
Guest. In the event of a lock-out, a minimum charge of $75.00 or the cost of a locksmith will be charged
to the Guest and by be charged to the credit card on file. Upon departure, return all keys, openers
and cards to the FVC office by 10AM.
10. TELEPHONE. Local telephone service may be provided. Any long distance or toll charges or
collect calls will be subject to service charge with a minimum fee of $25.00 per phone bill.
11. NSF CHECKS. Dishonored checks will be subject to a $50.00 service charge. Replacement
checks not including the $50.00 service charge will not be accepted.
12. USE OF PROPERTY. FVC and / or the Homeowner have the right to enter rental property to
make repairs and to examine and protect property during an emergency. Guest agrees that the
Homeowner’s agent has the right to show the property to prospective customers upon 12-to-24-hour
notice. Guest agrees to abide by and to have Guest invitees abide by the Rules and Regulations of
the Condominium Association or abide by the neighborhood deed restrictions, whichever is applicable.
13. MAXIMUM OCCUPANCY. The rental property cannot be occupied by more than the maximum
number of persons indicated herein, including children and infants. For purposes of this Reservation
Agreement, occupancy is defined as any overnight stays in the rental property. In the event the
maximum occupancy limit is exceeded, this Reservation Agreement will be cancelled immediately,
occupants will be removed from the property and all rental payments and deposits, whether earned or
unearned, will be forfeited.
14. CONDITIONS AND REPAIR. Guest agrees to keep the premises in good repair and in clean
condition and to pay the cost of repairing any damage to rental property caused by Guest or Guest’s
invitees. Guest will make no alterations to or upon said property, to include moving furniture. Guest
acknowledges that neither the Homeowner or FVC have made representations or warranties as to the
condition of the premises or any other matter not contained in this Reservation Agreement. Guest
agrees to return premises in as good a condition as the premises were at the time of occupancy, loss
or damage caused by acts of nature excepted.
15. MECHANICAL FAILURES AND MALFUNCTIONS. It is expected that major appliances and
systems break down from time to time. FVC will use its best efforts to have repaired as soon as
possible, but cannot guarantee that such repair will take place immediately. No refunds will be given
for circumstances beyond our control or for the failure, malfunction or loss of use of systems,
appliances or equipment.
16. INTERNET. From time to time, a disruption of service may occur due to circumstances beyond
our control. FVC makes no guarantee to connection, speed or reliability. No refunds will be given for
loss of use
17. TELEVISION. Each property varies in the type of service and television(s) it provides. FVC
cannot guarantee Range of Channels, Cable, Live TV, Smart TV / Streaming or DVR Services. From
time to time, a disruption of service may occur due to circumstances beyond our control. No refunds
will be given for loss of use.
18. CONSTRUCTION / RENOVATIONS. During your stay, there may be construction or renovations
occurring near your rental property. FVC and the Homeowner have no control over this. No refunds
will be given for any inconvenience due to construction / renovation noise or operations.
19. NO PETS. No animals of any kind shall be permitted in or on the rental property without the prior
written consent of FVC. If a pet is brought onto the rental premises without FVC consent, this
Reservation Agreement will be cancelled immediately, occupants will be removed from the property
and all rental payments and deposits, whether earned or unearned, will be forfeited.
20. NO SMOKING is permitted inside the property.
21. INSURANCE AND INDEMNIFICATION. Guest shall indemnify and hold harmless the Homeowner
and / or The Longboat Connection, Inc., D/B/A Florida Vacation Connection from and against any and
all liabilities, claims, expenses, fees, loss of use and actions of every kind and nature arising out of the
Guest’s use and occupancy of the rental property, except when such has resulted due to gross
negligence of the property owner or Florida Vacation Connection.
22. DEFAULT. In the event Guest breaches any term or provision of said Reservation Agreement,
the Homeowner shall have remedies provided by law, including the right to reenter and to sue in law
or equity.
23. INTEREST BEARING ACCOUNT. All deposits and prepaid monies may be placed in an interestbearing account with interest earned accruing to FVC.
24. RADON GAS. Radon Gas is a naturally occurring gas, that when it has accumulated in a building
in sufficient quantities, it may present a health risk to persons who are exposed to it over time. Levels
of radon gas that exceed federal and state guidelines have been found in buildings in Florida.
Additional information regarding radon and radon testing may be obtained from Guest County health
unit.
