PLEASE NOTE THAT IF ANY OF THE FOLLOWING RULES ARE BROKEN YOUR CONTRACT IS VOID, YOU WILL BE ASKED TO LEAVE IMMEDIATELY, AND NO REFUNDS WILL BE PROVIDED. SHORT TERM RENTAL AGREEMENTThis Short-Term Rental Agreement is made by and between AMG Vacation Rentals and Guest as of the date last set forth on their confirmed booking channel. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:The PropertyThe property location will be provided in the external contract the guest is to receive after booking with specific HOA, Community, City, and County rules and regulations listed in detail. Arrival instructions will be provided 24-48 hrs prior to arrival, along with any further pertinent details to your stay as long as all requested items are provided prior. City Ordinance Rules and PoliciesThe cities that our properties are in, have extremely strict vacation rental ordinances.  Please see the general info below but refer to your external contract with the specifications for the city you are renting in. Renter must be 25 years old, no more than 2 people per bedroom can occupy the home, no parties or events, no more than 2 cars can be parked at the property at any time unless otherwise, noted in the external contract, and no outdoor music is allowed at any time.  The fines for outdoor music are upwards of $1000, plus potential void of rental agreement requiring guests to vacate property with no refunds. These rules apply to all rentals hosted by AMG Vacation Rentals. No smoking inside the property, please. Period and GuestsRental period begins at 4:00pm on the designated check-in date and ends at 10:00am on the designated check-out date. Minimum Stay: AMG Vacation Rental properties require a variety of minimum stays ranging from 2-night to 30-night minimums.  Please be sure to review the external contract specific for your booked property as well as the information on the booking channel (A booking channel will not let you book an unapproved minimum stay). Rental Rules: Guest agrees to abide by the Rental Rules attached, at all times while at the property and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while at the property. Access: Guest shall allow AMG Vacation Rentals access to the property for purpose of repair and inspection.  AMG Vacation Rentals Team shall exercise this right of access in a reasonable manner. Cancellation Policy: The cancellation policy listed on your booking channel will be honored.  Please note there may be a non-refundable 5% credit card processing fee if you book on certain platforms.  Ab+b bookings are exempt to this. Insurance: We encourage all renters to purchase traveler insurance.  We provide coverage up to $1,500. 00 per 1-29 night booking period with our mandatory $69 Property Protection Fee which is applied to all bookings automatically, unless otherwise noted.  Please note that an additional $1,500. 00 refundable security deposit will be required for any stay 30+ nights that is not booked in airbnb. Renters/Guests are responsible for any and all damages caused during tenancy. Renter Rules & RegulationsNo smoking in the home. No loud noise, music, or parties. Any damages must be reported immediately. Take out trash from your stay and place in designated containers, any excess trash will be subject to fees. CONDITION OF THE PREMISES: Occupant has not viewed the Premises prior to entering into this Agreement.  Upon immediate arrival, Occupant shall examine the Premises, all furniture, furnishings, appliances, and fixtures, and immediately notify Owner or Owner’s Representative if any are not in operating condition or are in disrepair.  Reporting repairs does not give Occupant the right to cancel this Agreement or receive a refund of any payments made. UTILITIES: Owners are to pay all utilities up to $600 in a monthly period.  Guests will be responsible for anything exceeding.  Pool/Spa Heat is an additional fee and must be requested 48 hours in advance and must be paid the full stay, unless otherwise communicated (30+ night stays may have weekly and full-stay options).  The rates vary based on cost to the owner depending on CA gas rates.  Please inquire prior to booking for the current rate for your stay. RULES AND REGULATIONS: Occupant agrees to comply with any and all rules and regulations that are at any time posted on the Premises or delivered to Occupant.  Occupant shall not, and shall ensure that guests and licensees of Occupant shall not disturb, annoy, endanger, or interfere with other Occupants of the building in which the Premises is located or its neighbors, use for commercial use or any unlawful purpose, violate any law or ordinance, commit waste or nuisance on or about the premises.  Occupant shall not allow or cause loud broadcasting or amplification equipment. MAINTENANCE: Occupant shall properly use, operate, and safeguard the Premises including landscaping, furniture, furnishings, appliances, BBQ, and all mechanical, electrical, gas and plumbing fixtures, and keep them clean and sanitary.  Occupant shall immediately notify AMG Vacation Rentals team of any problem or malfunction or damage.  Occupant shall pay for all repairs or replacement caused by Occupant, guests and licensees of Occupant.  Occupant shall pay for all damage to the Premises as a result of failure to report a problem in a timely manner.  Occupant shall pay for repair of drain blockages or stoppages, unless caused by defective plumbing parts or tree roots invading sewer lines. ALTERATIONS: Occupant shall not make any other alterations in or about the Premises.  This includes all patios, garages, etc.  This includes, but is not limited to, moving furniture, wallpapering, adding or changing locks, installing antenna or satellite dishes, placing signs, displays or exhibits, or using ANY NAILS, SCREWS, FASTENING DEVICES, OR ADHESIVE MATERIALS to the interior or exterior.  NO pots, plants or additional furniture or any other items are allowed on patios other than what Owner has provided. NO ASSIGNMENT OR SUBLETTING: Occupant shall not assign any interest in this Agreement or sublet any part of the Premises or Occupant is in breach of Agreement. BREACH OF CONTRACT BY OCCUPANT: In the event of a breach of this Agreement, Occupant agrees to reimburse Owner for any and all financial losses sustained by the Owner as a result of the breach of Contract, including but not necessarily limited to attorney fees, costs of suit, service of process fees, re-renting fees and charges, advertising costs to procure a new tenant, lost rents during any period of renovation of the tenancy Premises for those items of cleaning and repairs above normal wear and tear for which Occupant is responsible, and renovation and/or rehabilitation costs for which the Occupant is responsible. OCCUPANCY: Occupant is renting the Premises as a transient lodger for the number of days specified from Owner who retains full legal, possessory and access rights. Legal Identification required for all guests age 18 and up. ENTIRE CONTRACT: All prior agreements between AMG Vacation Rentals and Occupant are incorporated in this agreement which constitutes the entire contract.  Occupant, hereby acknowledges, that they have read this Agreement, understand it, agree to it, and have been given a copy.
